Rate Litigation Representation From Former Public Service Lawyers

Howard Read, Sam Laniado, and Kevin Brocks are former staff counsel at the New York State Public Service Commission (“PSC”). In that capacity, they represented the DPS Staff in many electric, gas, steam, water, and telephone utility rate cases. Since forming Read and Laniado, LLP, in 1983, the firm has represented clients in a variety of rate cases. The firm has worked with clients’ in-house staff, or consultants hired by the client, to prepare rate request applications, conducted cross-examination of numerous witnesses, helped prepare testimony for witnesses, including training the witnesses for cross-examination, and briefed cases innumerable times including extensive motion and discovery practice.

Mr. Brocks and Konstantin Podolny represented the Long Island Power Authority in several rate cases. They worked with the Authority in the preparation, filing, prosecution, and briefing of the case.

Mr. Brocks has represented large water companies and municipal electric companies in the preparation of rate filings before the PSC. Mr. Brocks worked with the Jamaica Water Supply Company in the preparation, filing, prosecution, briefing, and/or settlement of five rate filings at the PSC. In addition, he represented the Long Island Water Corporation and Country Knolls Water Works in rate cases before the Commission. He and Mr. Podolny currently work with municipal utility departments in the preparation and filing of rate cases at the PSC.

Mr. Laniado, Mr. Brocks, Mr. Podolny, and David Johnson have represented a variety of clients, including governmental agencies, in Con Edison, National Grid, New York State Electric and Gas Corporation, and other utility rate cases as well as resource planning and other policy proceedings before the PSC.

Case 16-E-0060 – Consolidated Edison Co. of New York, Inc. Order approving a three-year electric and gas rate plan, issued by the Commission on January 25, 2017.

Case 15-E-0283 – New York State Electric & Gas Corp. Order approving a three-year electric and gas rate plan, issued by the Commission on June 15, 2016.

Matter 15-00262 – Long Island Power Authority and Service Provider. Rate plan recommendation that LIPA set rates designed to increase revenues by $30.4 million in 2016, $77.6 million in 2017, and $79 million in 2018, filed by the Department of Public Service on September 28, 2015.
